Total Treaty Freedom and the World State





1. Sovereignty and Universal Consensus


Sovereignty reaches its peak in total treaty-making
freedom (totale Vertragsfreiheit). Because states are
the sole creators of international law and no superior global
authority exists, the community possesses the constitutive power
to modify or terminate the entire system through universal
consensus.





2. Malleable Fundamental Norms


Even jus cogens (peremptory norms), such as the
prohibition of genocide, are not immutable. They are products of
contemporary universal legal conviction (opinio
juris). If the totality of states reaches a new consensus,
any fundamental norm can be redefined, replaced, or abolished.





3. Juridical Singularity via Treaty Chains


Fragmented legal orders consolidate into a unified global
architecture through interconnected "treaty chains"
(Vertragsketten) and supplementary instruments. These
mechanisms allow diverse systems (UN, NATO, ITU) to interlock,
enabling a single successor to merge the entire global treaty
history into a singular construct.





4. Territorial Expansion and the Domino Effect


The functional "sale" or takeover of states is driven by a
"domino effect" triggered by transferring infrastructure
"as a unit" (Erschließungseinheit). Global supply
networks (telecommunications, energy) are legally inseparable
units; as they cross borders or overlap, sovereign claims expand
along these physical connections until the entire world is
covered by a single claim.





5. Self-Contraction and the Clean Slate


When a successor unites all "rights" and "obligations" of every
previous treaty, they become "agreements with oneself".
Because an entity cannot maintain a contract with itself,
external obligations dissolve, creating a "clean slate"
(tabula rasa) to redesign the global order as a single
internal legal system.





6. The Event of Self-Abolition


The ultimate endpoint is the self-abolition of international
law (Selbstaufhebung des Völkerrechts). International
law dogmatically requires a plurality of sovereign
subjects. If states consensually unify into a single world
state, the "between-state" system vanishes, replacing
international law with a singular global internal order.
